Alcohol may have a role in fatal Madison Twp. accident

Sorting out liability in a multi-vehicle traffic accident can be a difficult task. In some cases, no witnesses are available. In others, the need for a painstaking accident reconstruction may delay the release of the necessary information. In a recent accident in Butler County, the police appear to have tentatively identified the negligent driver who caused the accident, but few details are available.According to police, emergency units received a call at about 6:30 p.m. on July 5 concerning a collision between a sedan and a pickup truck at a rural intersection. Three women appear to have been traveling south on Elk Creek Drive. The driver of the car, a Toyota Yaris, failed to obey a stop sign at the intersection of Elk Creek and Ohio 122. The car entered the intersection and was struck by a pickup truck driven by a man from Middletown. Both vehicles came to rest in a ditch adjacent to the intersection. The driver of the sedan and one of her passengers were pronounced dead at the scene. Both deaths were ruled accidental by the Butler County Coroner. The third occupant of the sedan was taken by medical helicopter to Miami Valley Hospital. The driver of the pickup received only trivial injuries, and he refused any kind of treatment. Police said that alcohol is believed to have been a factor in the accident, but the allegedly intoxicated driver was not identified. Because no news reports indicated that the driver of the pickup truck was cited for any alcohol-related offense, the most obvious inference is that the driver of the sedan was the person believed to have been intoxicated. The Butler County Serious Traffic Accident Reconstruction is conducting an extensive post-accident investigation.Anyone who has been injured or lost a loved one in a similar accident may wish to consider attempting to recover damages from the negligent party. In doing so, the assistance of an experienced accident attorney is a virtual necessity. A knowledgeable lawyer can review the evidence, identify the negligent party, develop legal theories to support a successful lawsuit, and estimate the likelihood of recovering damages for medical expenses, lost income, and pain and suffering.
